The Minister of Transport, Infrastructure and
Communities signed an Interim Order on the 23rd
of July which requires an Immediate Report for
dangerous goods, other than Class 9 Miscellaneous
Dangerous Goods, that are lost, stolen or unlawfully
interfered with during transport. This Interim Order
No. 001 provides Section 8.1 of the Transportation
of Dangerous Goods Regulations with new security
criteria for making an Immediate Report.
The
provision for an Interim Order is a new feature of
the newly amended Transportation of Dangerous Goods
Act, under subsection 27.6(1), which allows for an
immediate action to ensure public safety. It remains
in force for two years, until repealed or until the
TDG Regulations are amended to have the same effect.

Interim Order No: 001
Interpretation
1. Words and expressions used in
this Interim Order and defined in the
Transportation of Dangerous Goods Act, 1992 or
the Transportation of Dangerous Goods
Regulations have the same meaning as in that
Act or those Regulations, as the case may be.
Report
2. A person who, in the course of
the importing, offering for transport, handling or
transporting of dangerous goods, other than
dangerous goods included in Class 9, discovers
that any of those goods have been lost or stolen
or otherwise unlawfully interfered with must
immediately report that discovery to:
a) the local police;
b) CANUTEC at
613-996-6666; and
c) in the case of
goods included in Class 7, the Duty
Officer of the
Canadian Nuclear Safety Commission at
613-995-0479.
This Interim Order should be kept
with your TDG Regulations Binder until such time as
a formal Amendment to the Regulations is published
which supersedes the Interim Order.
