TORONTO, Dec.
21 - Aurora Overhead Door Inc., an Aurora, Ont.-based seller
and installer of industrial-sized overhead doors, was fined
$50,000 today for a violation of the Occupational Health and
Safety Act that resulted in serious injuries to an employee.
On May 17, 2005, a worker was on a
7.3-metre (24-foot) extension ladder adjusting a
newly-installed overhead door and putting weather stripping
around the frame when the worker slipped and fell to the floor
below. The worker suffered head, chest and back injuries. A
Ministry of Labour investigation found one of the factors that
contributed to the incident was that the worker was not
wearing fall protection equipment. The incident occurred at an
industrial establishment at 100 Carson Street in Toronto where
Aurora Overhead Door Inc. had been contracted to install the
overhead door.
Aurora Overhead Door Inc. pleaded
guilty, as an employer, to:

failing to ensure the worker wore fall protection
equipment where there was a risk of falling more
than three metres, as required by Section 26.1(2) of
the Regulations for Construction Projects. This was
contrary to Section 25(1)(c) of the act. |
The fine was imposed by Justice of
the Peace Peter Wilson of the Ontario Court of Justice at Old
City Hall in Toronto. In addition, the court imposed a
25-per-cent victim fine surcharge, as required by the
Provincial Offences Act. The surcharge is credited to a
special provincial government fund to assist victims of crime.
