Are Your Material Safety Data Sheets Up-to-Date?
 

The Bondfield Construction Company Limited located in Concord, Ontario, was fined $20,000 plus a 25% victim surcharge on November 17. This is due to an incident that occurred at a building site in Sault Ste. Marie, Ontario, in September 2006. The incident involved using a hazardous substance in the workplace without having a proper MSDS for that substance available.

Bondfield was found guilty of failing, as an employer, to obtain or prepare an up-to-date material safety data sheet for all hazardous materials present in a workplace, as laid out in clause 37(1)(b) of the Occupational Health and Safety Act.

Your annual review of WHMIS training should include a review of the material safety data sheets for the hazardous products being used, the precautions and emergency procedures stipulated in those MSDS and, of course, whether those MSDS are up-to-date.
