What is Workplace Violence & Harassment (WVH)?

Most provinces have specific definitions of Workplace Violence & Harassment, however a few general examples are:
  • degrading comments;
  • bullying;
  • threats;
  • intimidation; and,
  • physical violence.

Do I need a Workplace Violence & Harassment Course?

Most provinces have developed their own WVH regulations. These province-specific legislations more clearly define an employer’s legal responsibilities when it comes to WVH. For those provinces that have not yet developed specific WVH regulations, they still fall under a general duty clause in the provincial regulations. Also Workplace Violence and Harassment regulations can be found in other federal and provincial regulations, employment standards, workers compensation and the human rights act.

Click here to reference a list of all the provincial Workplace Violence & Harassment Regulations.

General training (such as this course) will cover the general legislation, how to identify, deal with, resolve and report WVH, as well as strategies to prevent violence and harassment in the workplace.

Ontario Specific: Do I need Workplace Violence & Harassment training?

Yes, all workplaces in Ontario need to have a Workplace Violence and Harassment training program which includes a 'written and posted policy' and 'training' for every employee (such as YOW Canada's online course).  The only exception is for workplaces with 5 or fewer 'regular employees':  In this case all employees still require WVH training but the 'wVH 'policy' may be delivered verbally (no need to have the policy written and posted).  For more details on the Ontario specific regulations please view the Ontario Health and Safety Act (OHSA).

Who is responsible for ensuring that my employees are adequately trained?

Regardless of the source of training or how it is provided to workers, the employer has the duty to ensure it is adequate to protect the health and safety of the workers.

It is up to the employer, in consultation with the Joint Health and Safety Committee or health and safety representative, if any, to determine the level and type of training provided, and to ensure it is adequate.

How often do I need Workplace Violence & Harassment Training?

General training must be given to every employee. Workplace Violence & Harassment should be repeated when there are significant changes to the policy or program or when circumstances indicate training should be repeated such as policy or procedures are not being followed.

Consult with your provincial government's labour legislation, your industry’s provincial safety association or Worker's Compensation Board for details on when re-certification is required.

How can we comply with the Regulations?

Design a Workplace Violence & Harassment Program and written Policy that:
  1. Includes measures and procedures to control the risks (identified in assessments) which are likely to expose workers to physical injury;;
  2. Includes measures and procedures for summoning immediate assistance when workplace violence occurs or is likely to occur;
  3. Specifically explains what constitutes harassment;
  4. Includes measures and procedures for workers to report incidents of workplace violence and harassment to the employer or supervisor; and
  5. Sets out how the employer will investigate and deal with incidents or complaints of workplace violence and harassment.

Who is responsible for Workplace Violence & Harassment training?

The onus is on the employer to ensure that his or her staff is adequately trained. The responsibility to ensure workers are trained and the manner in which training is conducted rests with the employer. YOW Canada’s Workplace Violence & Harassment Course is one method of training.

What needs to be included in a Workplace Violence & Harassment training program?

Both general and site-specific training are required.

YOW’s Workplace Violence & Harassment Course is general training that covers the legislation, how to recognize Workplace Violence & Harassment and how to address it.

Practical site specific training may also be required to cover the particular workplace and the specific policy and procedures.

How is compliance with the Regulations monitored?

Compliance activities are conducted by the provincial, territorial and federal agencies responsible for occupational health and safety (OHS). These OHS agencies conduct compliance programs and workplace inspections.
